RZ AIRflow LIMITED WARRANTY TO ORIGINAL CONSUMER for True HEPA PTAC Air Purifier (the “Product”)
This Product, as supplied and distributed in new condition, is warranted by RZ AIRflow to the original purchaser of the Product against manufacturing defects (“Warranty”) subject to the terms and conditions discussed below. PLEASE NOTE: THIS WARRANTY COVERS ONLY THE PRODUCT (True HEPA PTAC Air Purifier), AND DOES NOT COVER ANY PTAC UNIT WITH WHICH THE PRODUCT MAY BE USED.
- WARRANTY TERMS:
PRODUCT WARRANTY: For a period of one (1) year from the date of the original customer purchase ("the Warranty Period"), if this Product is determined by RZ AIRflow to be in non-conformance with its specifications established by RZ AIRflow and in force and effect on the date of purchase of the Product, RZ AIRflow will, at its sole discretion and option, either: (i) replace the non-conforming Product with a new Product, at no charge to the original customer, (ii) refund the original purchase price of the Product (excluding tax) to the original customer, or (iii) issue a credit to the original customer in the amount of the original purchase price of the Product (excluding tax).
SPARE AND REPLACEMENT PARTS WARRANTY: RZ AIRflow warrants any spare parts sold by RZ AIRflow for use in the Product to be free from defects for a period of 90-days under proper use, maintenance and care according to the Product labels or in the Product User Guide. The warranty covering spare or replacement parts shall begin on the date the spare or replacement part is first shipped to the customer.

WARRANTY TIMING AND PROCEDURE: Before the Warranty Terms can be fulfilled, the original customer purchaser must contact RZ AIRflow for problem determination and troubleshooting, and to coordinate return of the Product to RZ AIRflow if applicable. Proof of purchase evidencing that the Product is within the Warranty Period must be presented to RZ AIRflow in order for the Warranty Terms to take effect. - EXCLUSIONS AND LIMITATIONS TO WARRANTY SERVICE: This Warranty covers Product non-conformity in the normal, non-commercial use of the Product, and does not cover (a) damage or failure caused by or attributable to Product abuse or misuse, improper application of the Product, use of the Product under abnormal conditions or under conditions not reasonably foreseeable to or beyond the control of RZ AIRflow, failure to follow directions, instructions and/or terms set forth on the Product labels or in the User Guide, (b) transportation, shipping, delivery, insurance, installation or set-up costs; (c) costs of product removal, transportation, or reinstallation costs; (d) ordinary wear and tear, cosmetic damage or damage due to acts of nature, including but not limited to water, floods, wind, storm, tornado, earthquake, or fire, or due to damage caused by extraordinary impact events, such as dropping or crushing; (e) use of the Product with a non-compatible PTAC unit or with a non-compatible HEPA filter, or damages caused by failure of or defects in a PTAC unit, or (f) modification or manipulation of the Product or any part of the Product.
This Warranty DOES NOT cover any PTAC unit with which the Product may be used, or any components of a PTAC unit or any related product to a PTAC unit that are not included with the Product at the time of the original purchase by the original purchaser of the Product.
This Warranty applies only to the original consumer purchaser of the Product. This Warranty is valid only in the United States and Canada, and only applies to products purchased and serviced in the United States and Canada. All Products on which a replacement, refund or credit is made become the property of RZ AIRflow. The use or addition of parts, accessories or features to the Product that are not manufactured or recommended by RZ AIRflow could affect the intended function of the Product, and therefore void the Warranty. The Warranty is contingent upon the proper use, maintenance and care of the Product. The Warranty may be void if the Product has been used in a manner contradictory to or in violation of the directions, instructions and/or terms set forth on the Product labels or in the Product User Guide. The customer assumes all responsibility for use of the Product not in accordance with the directions, instructions and/or terms set forth on the Product labels or in the Product User Guide, and as such, the customer is responsible for any safety hazards or risk, damages or failures caused by or attributable to use of the Product not in accordance with the directions, instructions and/or terms set forth on the Product labels or in the Product User Guide. RZ AIRflow makes no warranty, whether express or implied, for the use of the Product other than for the purposes indicated on the Product labels or in the Product User Guide.
This Warranty is made in lieu of and supersedes all other warranties or conditions of merchantability or fitness for a particular purpose or general use, whether express, implied, collateral, statutory, or provided by common law, the Uniform Commercial Code or otherwise. RZ AIRflow further disclaims all warranties after the end of the Warranty Period defined above. No other express warranty or guaranty given by any other person, firm or entity with respect to the Product shall be binding on RZ AIRflow. Replacement, refund or credit of the original purchase price, at RZ AIRflow's sole discretion, are the exclusive remedies of the customer. RZ AIRflow shall not be liable for any incidental or consequential damages caused by the use, misuse or inability to use the Product. These include but are not limited to any damages in the form of lost profits, loss of use, legal fees, economic loss, personal injuries, or any other damages caused by circumstances beyond the control of RZ AIRflow. Notwithstanding the foregoing, the customer's recovery shall not exceed the purchase price of the Product. This Warranty shall not extend to anyone other than the original customer who purchased the Product, and is not transferrable. No person is authorized to alter, extend or waive the Warranty of RZ AIRflow.
Some states do not allow the exclusion or limitation of incidental or consequential damages, or allow limitations on warranties, so the above limitations or exclusions may not apply to you. This Warranty gives you specific rights, and you may have other rights, which vary from state to state. The exclusions and limitations to the Warranty apply to the maximum extent permitted by law and unless restricted or prohibited by law. Where any term of this Warranty is prohibited by applicable law, it shall be null and void, but the remainder of this Warranty shall remain in effect.
